This is not correct.
It may be that an employee, particularly a long term employee, is entitled to reasonable notice in excess of the notice provided by the NES.
What constitutes reasonable notice depends on the circumstances of each case but, as a general rule, the longer the employee has worked for the employer and the more senior and important the position they occupy, the greater their entitlement will be to a reasonable notice period. Other relevant factors may include the employee’s age, anything they have given up to undertake the position, for example where they resigned from a secure position.
It is very important that a written employment agreement be provided which sets out how the employment relationship can be ended.
