Liability Decision in David and Goliath case
Nicole Dunn Lawyers is pleased to share the significant decision in the case of Priscilla Atkins v North Australian Aboriginal Justice Agency Ltd [2024] FCA 686. On Thursday 27 June 2024, Justice Charlesworth of the Federal Court of Australia delivered her liability judgment in favour of our client, Priscilla Atkins.
In this landmark decision, the court found that the North Australian Aboriginal Justice Agency (NAAJA) took adverse action against its CEO, Priscilla Atkins, during her employment, in breach of the Fair Work Act 2009 (Cth) and further that her employment as CEO of NAAJA is ongoing.
A timetable for the remedy hearing will shortly be set.
Priscilla Atkins expressed her relief and gratitude: “Thanks to my amazing legal team…Nicole and Kate. You are the ones who got me through this. I can’t thank you enough for all your hard work…It’s a huge relief and I can finally breathe again”
Nicole Dunn, the firm’s Principal, stated, “I’m so happy for Priscilla and I’m also so proud of my team. We all worked incredibly hard to achieve this outcome for our client, well done all – especially Malcolm Harding SC, Renae Kumar, barrister and our own Kate Gibson
